The Administrative Court will rule on November 21 in the case initiated by the complaint of the candidate for mayor of the Municipality of Dobrich, brought by the PP GERB Krasimir Hristov Nikolov against the decision of the Municipal Election Commission to announce the results of the runoff on November 5.
Today, the case was opened in open session. At Nikolov’s request, the ballots were counted in five of the sections.
It was carried out on the basis of Art. 437, para. 2 and para. 3 of the Electoral Code, which clearly indicate which ballots are valid and which are invalid. The judge reporter in the case, Neli Kamenska, rejected the request for the admission of technical expertise and determined as unfounded the request to count the ballots in all sections.
Actual ballots were found, reported as invalid, and vice versa, explained Krasimir Nikolov. “Although they did not affect the result, it was important to raise the alarm and make it clear that not everything is fine,” he added. And he emphasized that many of the ballots for Yordan Yordanov have a bold cross, but no one can say whether they are valid or not. The law states that the choice is indicated with a cross, without specifying whether it is bold or not, Nikolov added.
“We wanted to demand reports to the State Security Service, the Ministry of Internal Affairs and the Prosecutor’s Office for vote buying or other actions during the runoff,” said Krasimir Nikolov. Judge Kamenska rejected this request.
The court will rule on the final act in the case, and the protocol will be prepared by the end of the working day, November 21. The parties will have 7 days for written submissions.
