The court in Kyustendil left 4 Afghans caught a step away from the Serbian border in permanent custody

District Court – Kyustendil took measures for remand “Detention in custody” in relation to 4 people, three of them minors, citizens of Afghanistan. All of them have been brought by the prosecutor’s office as defendants for a crime under Article 279, paragraph 1 of the Criminal Code, for the fact that on 17.11.2023, in the area of ​​the village of Pobit Kamak, Municipality of Treklyano, about 50 meters from the state border line, have attempted to cross the country’s border into the Republic of Serbia, without the permission of the appropriate authorities and not through the designated places.
For the specified composition of the crime, a punishment of “imprisonment” for a term of three to six years and a fine of BGN 1,000 to BGN 5,000 is provided. It is severe in the sense of the Criminal Code. In the course of the pre-trial proceedings, evidence was collected, which forms a body of evidence from which, despite the early progress of the investigation, the conclusion of the defendants’ complicity in the act is not shaken. There is a lack of indisputable data on the identity of foreign nationals, their age and criminal record. At the time of their detention, the four were without identity documents. They do not have a permanent address on the territory of Bulgaria, they do not have a place of work, they do not know the Bulgarian language, and the probability that they have made other attempts to carry out the same act is not ruled out. An additional argument is that there is no evidence in the case that the defendants entered the country legally, according to Judge Kalin Vasilev’s reasons for imposing the most severe measure of non-abortion.
The determinations of RS – Kyustendil, with which the most severe measure of remand “Detention under custody” was taken in relation to the four foreign citizens, are subject to appeal with a private complaint and private protest, before the District Court – Kyustendil.
