Prosecutors and investigators from the Dobrich judicial district express their disagreement with the Bill on the Judiciary in an opinion

The District Prosecutor’s Office – Dobrich has sent to the Ministry of Justice an opinion of prosecutors and investigators from the Dobrich judicial district in connection with the draft Law on the Judiciary and the reasons for it. This was announced at a briefing by the district prosecutor of Dobrich, Radoslav Bukhchev.
The district attorney said that according to the opinion expressed, an “institutional war” has been waged against the prosecutor’s office in recent times, although it stands aside from politics and politicians, and the adopted changes to the Constitution are not approved by specialists in the field of constitutional law.
“These changes also led to the preparation of a new draft law on the Law on the Judiciary (JSW), the aim of which is to take control of the prosecutor’s office by politicians and the political class. The District Prosecutor’s Office will not work under conditions of subordination and dependence. In the opinion, we express disagreement with the opposition of individual bodies in the judiciary and their unequal treatment. With the draft for a new ZSV, prerequisites are created for breaking and mastering the prosecution and the investigation. And also for degrading their role within the judicial system,” said Radoslav Bukhchev. He added that in the opinion they also paid special attention to the method of formation of the personnel body of the prosecutor’s office, the Supreme Prosecutor’s Council, and the preponderance of members elected by the National Assembly, which, according to them, would put the prosecutor’s office in a position of political dependence and the consequence and would lead to their being unable to fulfill their powers provided for in the Criminal Procedure Code.
“The approach to forming the composition of members of the personnel body of the court and that of the prosecutor’s office is different. The last proposal of the draft law is striking, which is the provision of Article 19, paragraph 3. According to it, the National Assembly cannot elect as members of the two councils persons who hold the position of prosecutor or investigator at the time of election. In this form, the proposed norm sounds humiliating and insulting to prosecutors and investigators. Another issue is that it is also unconstitutional,” prosecutor Buchchev concluded.
He expressed hope that all the opinions of the affected persons and institutions will be taken into account, and a workable Judiciary Law will be made.
