On the MP “Captain Andreevo”: They detained a 34-year-old man, who was declared an international wanted man – Newspaper “Stariyat Most”

Today, by order of the District Court – Haskovo, in an open court hearing in a private criminal case at the request of the District Prosecutor’s Office – Haskovo, a remand measure was taken “Detention in custody” in relation to A.A.G. aged 34, with a Turkish national declared internationally wanted by the Romanian authorities on the basis of a European Arrest Warrant.

The man was detained at the Kapitan Andreevo border crossing upon entering the country. The order was issued by a court in the city of Giurgiu, Romania, for three committed crimes – putting into circulation a product bearing an identical or similar brand to a registered trademark, for which he was sentenced to “Imprisonment” of 1 year and 1 month .

The court accepted that the submitted request meets all the requirements based on Art. 36 and Art. 37 of the ZEEZA, which states the crime for which A.A.G. is wanted, the place and time of its execution. From the documents presented by the District Prosecutor’s Office – Haskovo, attached to the request for extradition, it is clear that A.A.G. has a sentence that entered into force from June 2023. The acts thus committed are also crimes under the Bulgarian Penal Code, which are punishable by “imprisonment”. According to the court, there is a real danger A.G. to hide, as the reasons for this are contained in the nature and severity of the incriminated crime, and the amount of the prescribed punishment. He is a foreign citizen, he has not only a permanent address in the country, but also any data about his connection with Bulgaria, which would presuppose his stay in the country. There is no medical evidence that the person requested to be surrendered has any diseases that would constitute an obstacle to stay in the conditions of arrest. With these considerations, the court justified the adoption of a remand measure “Detention in custody” as a guarantee for his appearance before the court in the actual proceedings for his extradition.

The ruling is subject to appeal and protest before the Appellate Court – Plovdiv within 3 days from the date of the ruling and its announcement at a court session, as in the case of an appeal and/or protest, the case is scheduled for consideration by the Appellate Court – Plovdiv on April 30.
