The Affair at the Customs: The Prosecutor’s Office wants Dimitrov’s father to be returned to custody

The Sofia City Court imposed a measure of “detention in custody” for Marin Dimitrov after accepting that there is sufficient evidence of sympathies with the organized crime group.

As of now from the case materials it is not established that he has a connection with cigarettes without a banderol. The court held that there is no danger of the accused abscondingbecause he came to the courtroom himself.

The character and the burden of the prosecution, however, are enoughin order to take a “detention in custody” measure.

The extreme public danger, involving many persons and those in high government positions, is a prerequisite for detention. The fact that there are persons who have a measure other than custody is a decision of the prosecutor’s office, not the court. There is a forensic medical examination which shows that the health condition of the accused does not prevent him from being in custody. Before the court, the accused stated that he did not know the head of the “Customs” agency and did not talk to customs officials about smuggling.

The definition is not final and subject to appeal or protest. In case of such, the court session is scheduled for April 30 before the SAC.
