With the regular package of Member State infringement decisions, the European Commission takes legal action against Member States that do not fulfill their obligations under EU law. This was announced by the press center of the European Commission.

Decisions on infringement procedures against Bulgaria are related to the internal market, industry, entrepreneurship and SMEs.

The European Commission has decided to initiate infringement proceedings by sending a reasoned opinion to Bulgaria and two other member states in connection with non-compliance with the legislation in the field of public procurement. The rules on public procurement and concession contracts had to be transposed by Member States into their national law by 18 April 2016.

The Commission is addressing Member States on various issues related, inter alia, to restrictions on the rights of operators, in the case of Romania, and the exclusion of private hospitals from EU public procurement rules, even when they are partly financed with public funds — in the case of Bulgaria.

Justice

The European Commission has decided to open infringement proceedings by sending an additional letter of formal notice to Bulgaria for not correctly transposing the Directive on the strengthening of the presumption of innocence and the right of persons to be present at the trial in criminal proceedings. The Commission sent a first formal letter of notification to Bulgaria in September 2023, but identified further problems in the transposition of the provisions on absentee trials and the right to a new trial.

The Commission also decided to send an additional letter of formal notice to Bulgaria for non-compliance with the Framework Decision on the European Arrest Warrant (EAW) and surrender procedures between Member States. Bulgaria has responded to previous complaints, but in subsequent amendments it has not correctly transposed the provisions related to the continued detention of the wanted person.

Mobility and transport

The Commission decided to send a reasoned opinion to Bulgaria in connection with the transposition into national legislation of the TEN-T Directive regarding the optimization of measures to achieve progress in the implementation of the trans-European transport network. In September 2023, the Commission sent an official letter of notification to six Member States, including Bulgaria, as they had not notified the measures for transposition into their national legislation. The Commission considers that the Directive has not yet been fully transposed by these Member States.
