The court considered that there was a reasonable assumption of authorship of the incriminated act, as well as a danger that the accused would commit a crime or abscond. The 32-year-old woman has been convicted of trespassing on multiple occasions, and has effectively served prison sentences. The 36-year-old man has also been convicted on multiple occasions, in many cases serving prison terms, which he effectively served. In the case, there is evidence that the accused do not reside at their permanent address and lead a nomadic lifestyle. The court accepted that from the collected evidence a reasonable assumption can be made about the authorship of the act, as well as that there is a real danger that the accused will commit a crime or abscond.
The court accepted a request submitted by the prosecutor’s office to impose the most severe measure of procedural coercion also in relation to a 41-year-old man, who was charged with theft in a continuing crime and dangerous recidivism. Accusations have been brought against him that in the period April 17-20 of this year in Varna he stole food products and alcohol from a commercial establishment. The 41-year-old man has been convicted many times. Regarding him, there is no address in Varna where he resides permanently.
From the materials collected in the case up to the present moment, the court accepts that a reasonable assumption can be formed regarding the complicity of the accused in the crime for which he is brought to criminal responsibility. The court also finds that there is not a hypothetical, but a real danger that the accused will commit a criminal act or abscond when a remand measure other than “Detention” is taken.
The deadline for appealing the imposed measures is 3 days. In the case of appeals, the cases are scheduled for hearing before the District Court on April 30 at 1 p.m.
