Administrative Court – Silistra overturned a decision of the Silistra District Court (SRS), canceling an order of the Director of the Regional Directorate “Agriculture” (ODZ) – Silistra to determine the rental price of agricultural land.
The case study:
ODZ – Silistra sets a rental price of BGN 163 per hectare for agricultural land in the land of the village of Voinovo. “Zemedelska tehnika” OOD appealed the order, and the SRS canceled it.
Decision of the Administrative Court – Silistra:
The court overturned the decision of the SRC on the grounds that:
• The administrative and production rules were not observed when determining the price.
• The SRS performed an inadmissible indirect judicial review of a previous order of ODZ – Silistra, which was not appealed.
• The price determined by the order is in accordance with the monetary value fixed in the previous order.
Consequences:
• The order of the ODZ – Silistra to determine a rental price of BGN 163 per hectare for agricultural land in the land of the village of Voinovo remains in force.
• “Zemedelska tehnika” OOD was ordered to pay ODZ – Silistra BGN 1,070 in costs.
The decision is final.
