The verdict of the District Court – Dobrich entered into force, by which the defendant Yulia Stamatova – former chairman of the “Yordan Yovkov” community center – was acquitted of the charge of having committed a crime while on duty. The defendant was found not guilty in that for the period from 2004 until 2014 in Dobrich, under the conditions of a continuing crime, in her capacity as an official who holds a responsible position – chairman of the national community center “Yordan Yovkov”, she did not fulfill her official duties, as she did not supervise the fulfillment of the company’s obligations under 4 contracts for a joint activity with the aim of obtaining a benefit for two companies in the amount of BGN 262,937.52, and the act has caused significant material and non-property harmful consequences for the community center, with those of a material nature amounting to BGN 611,885.95 and is related to the leasing of municipal property.
The acquittal thus rendered was protested by the prosecutor’s office before the Varna Court of Appeal, which annulled the first-instance court act. The appellate court passed a new sentence, by which the defendant was found guilty of having committed the crime specified in the indictment, which resulted in significant non-property and pecuniary consequences for the community center, the latter in the amount of BGN 485,171.37. The defendant was given a conditional sentence of imprisonment, a fine and a sentence of deprivation of the right to hold a public office as chairman of a community center for a period of 5 years. The appellate court acquitted the defendant on the charges brought regarding the amount of the harmful consequences of a property nature over the amount of BGN 485,171.37.
The verdict of the appellate court was appealed by the defenders of the defendant Stamatova before the Supreme Court of Cassation. After examining the contested legal act, a three-member panel of the Supreme Court overturned the appellate verdict of the Court of Appeal-Varna, in its condemnatory part, and acquitted the defendant of having committed a crime while on duty, as the District Court of Dobrich also ruled.
The decision of the Supreme Court is not subject to appeal, which means that the acquittal of the District Court – Dobrich also enters into legal force.
