The Kyustendil District Court confirmed the remand order taken by the District Court in Dupnitsa against the son of the district prosecutor from Pernik Biser Mihailov – Vasil. The decision is not subject to appeal or protest, BTA reported.

At the end of last month, the District Court in Dupnitsa took a measure of remand “in custody” in relation to the 20-year-old man, brought by the Sofia District Prosecutor’s Office as an accused of a crime – threatening to kill a girl with whom they had an intimate relationship.

The right should not be protected by magistrates who do not know it, but practice it as a trade, said after the hearing for BTA the defender of the accused Lyubomir Takov, who quoted a judge from the Appellate Specialized Criminal Court. “I will immediately issue a new request to amend the remand order,” said Takov and commented that the decision of the Kyustendil District Court was “outrageous”.

“My client is undergoing a measure of remand house arrest, which, according to a 1992 decision of the Supreme Court, is equivalent in legal meaning and consequences to detention in custody. Indeed, it is a question of two different proceedings, but the objectives of the measures are to prevent absconding and commission of a crime or the thwarting of enforcement of an effective sentence,” Takov also pointed out.

Before the court, Vasil Mihailov said that he wanted a lighter measure so that he could enjoy his relatives and the little freedom he has while under house arrest. He said he was under psychological pressure because at the age when his peers were entering university, he was going to prison. “I swear by my mother, whom I only love, that I am accused of being a bully – something that I am not,” Mihailov said, adding that he is a “good person”, although he has also done bad things. According to his explanations before the court, the accusations of his ex-girlfriend Boryana Rangelova are the result of her jealousy of him and there is no evidence for them.

On September 13, the Sofia District Prosecutor’s Office charged Vasil Mihailov with four threats to kill his girlfriend. In one of the cases, the girl was hit by him. The first case of threat was already when Mihailov was initially released under house arrest about a year ago. The other death threats were in December 2022, July 1 and July 21 this year.

Mihailov is accused of eight other crimes committed on the territory of Pernik, in the period from November 2021 to June 2022. In the case against him, an indictment was filed in court for causing moderate bodily harm to three people, minor bodily harm due to hooliganism to two, for indecent acts grossly disturbing public order, and for threatening to kill.

By decision of the Supreme Court of Cassation, the case terminated before the court in Pernik was sent for consideration to the District Court – Dupnitsa.

Currently, there are two other pending pre-trial proceedings against Mihailov.
