A retired New York City police officer was sentenced to 10 years in prison yesterday for attacking the Capitol building and using a metal flagpole to attack a law enforcement officer who was trying to hold back a crowd of Donald Trump supporters, the Associated Press reported.

Thomas Webster’s effective sentence is the longest to date of a total of around 250 people already sentenced for their conduct during the riot on 6 January 2021. The previous longest sentence was for two other rioters who were sentenced to 7 years and 3 months in prison.

Webster, a 20-year veteran of the NYPD, is the first defendant in the Capitol storming to stand trial for assault and the first to plead self-defense. A jury rejected Webster’s claim that he was acting in self-defense when he scuffled with police officer Noah Rathbun outside the Capitol on Jan. 6 and pulled off his gas mask.

District Judge Amit Mehta sentenced Webster, 56, to 10 years behind bars and three years of supervised behavior outside prison, noting that “in addition to Rathbun, democracy was also a victim.”

Federal prosecutors had asked for a sentence of 17 years and 6 months in prison. Prosecutors accuse Webster of “disgracing the democracy he once so honorably defended and served.” Webster led the group that marched against the police barricades in the Capitol Lower Plaza. Prosecutors compared the attack to a medieval battle, in which the attackers used homemade grenades against the police and engaged in hand-to-hand combat with them.

Webster’s attorney said his client was dragged by the crowd but did not enter the Capitol. According to the defendant’s counsel, the crowd was “led by unscrupulous politicians” and others spreading the lie that the 2020 presidential election was stolen by the then head of state.
