The opinion was adopted at a meeting of prosecutors and investigators from the Dobrich judicial district, held on 04/19/2024. in Dobrich and was sent to the Minister of Justice
The adopted changes to the Constitution of the Republic of Bulgaria, which were not approved by the specialists in the field of constitutional law, led to the preparation of a project for the Law on Judicial Power, which, according to the prosecutor’s office in Dobrich, aims to control the prosecutor’s office by politicians and the political class. “The District Prosecutor’s Office will not work under the conditions of subordination and dependence,” emphasized the administrative head of the District Prosecutor’s Office, Radoslav Bukhchev.
In their Opinion, the prosecutors express their disagreement with the opposition of individual bodies in the judiciary and their unequal treatment. According to them, the draft for a new Criminal Justice Act creates prerequisites for breaking and controlling the prosecution and the investigation and for degrading their role in the judicial system. In their opinion, they also pay attention to the new way of forming the High Prosecutor’s Council. The preponderance of members elected by the National Assembly would place the prosecutor’s office and the investigation in a position of political dependence and in the inability to fulfill their powers provided for in the Criminal Code, would deprive them of their independence, the opinion says.
An institutional war is being waged against the prosecutor’s office, the authors of the opinion are emphatic.
The district prosecutor Radoslav Bukhchev expressed hope that all the opinions of departments, institutions and organizations will be carefully reviewed and a good ZSV will be adopted, which will be in the interest of society and the state.
