The biggest insanities in Bulgaria in laws: Prof. Daniel Valchev speaks

--

He specified that the new issue of “Legal Barometer” refers to the last 6 months of last year. According to him, during these six months, there are laws that have been amended seven times every 40 days, such as the Excise Law, the Judiciary Law and others.

He nevertheless drew attention to the fact that a large part of the legislation is normal, but the unflattering examples continue to develop and seem to multiply.

“From the point of view of the legislation, it turns out that it doesn’t really matter whether the persons are new or old. What happened, continues to happen,” commented Prof. Valchev. MORE: Legal reality: Energy oddity, per-kilo laws and rise in constitutional appeals (VIDEO)

The additional transit fee for “Gazprom”

Prof. Valchev also commented on a law whose title he defined as dramatic. It is a matter of the Law on the control of the implementation of restrictive measures in view of the actions of Russia, destabilizing the situation in Ukraine. “This law has three changes that happened within three months. It was decided that additional fees should be imposed on Gazprom. In the end, it turned out that Bulgartransgaz had to pay these things. The middle of in November it was corrected that “Gazprom” should pay them, and in mid-November all this was canceled with retroactive effect.

The definition of an intimate relationship

He also commented on the amendments to the Law on Protection from Domestic Violence, which the MPs adopted, and noted that giving a definition of an intimate relationship is not a simple task.

“In the beginning, the idea was that it was a relationship between two people. That was quite enough for a competent judge to determine when such a relationship existed. Someone raised the question of whether a one-time intimate relationship could lead to legal consequences. Then it started to argue how long this relationship should last. From here arose the other big question, which thank God is not settled in this legal definition – from when do those 60 days count, from the first thrill, from the first kiss or, if you do not have a red dot, I will stop guessing now”, comments Prof. Valchev.
