Time limits and limitations of unemployment benefits – Insurance

The legislation of many countries, including Bulgaria, establishes the right to monetary compensation for persons who are unemployed and meet certain criteria.

This is a measure that aims to help people facing unemployment and provide them with financial support while they look for a new job. Dr. Todor Kapitanov, an expert in labor law, explains what are the peculiarities of the conditions for the use of this type of compensation.

According to the law in Bulgaria, the right to monetary compensation for unemployment is granted to persons for whom insurance contributions have been made or are due to the unemployment fund for a period of at least 12 months in the last 18 months before the termination of insurance. This means that people who have worked and paid social security contributions are entitled to receive support in case of unemployment.

Unemployment benefit is essential to help those facing unemployment meet their basic needs while they look for new work. The unemployment benefit system was created to provide social security and stability for individuals in society who are temporarily out of work.

In accordance with Bulgarian legislation, in order to be recognized as unemployed and to receive monetary compensation, individuals must meet several conditions.

First, to be registered as unemployed with the Employment Agency. This requires individuals to register with the competent employment authority and prove their unemployed status by providing the necessary documentation and information. Then it is necessary to prove that they do not receive a pension for length of service and age, i.e. they must not have acquired the right to a pension for insurance length of service and age in Bulgaria or in another country. Also that they do not receive a reduced pension for insurance service and age or an occupational pension. Finally, to meet the condition that do not exercise labor activity subject to compulsory insurance.

Individuals cannot be recipients of cash unemployment benefits, if they work under contractfor which compulsory insurance is required, or if they are self-employed and have not paid social security contributions.

Changes for Bulgarians working in Germany

Cash unemployment benefits are paid monthly in the month following that for which they are duefor a period determined according to the duration of the insurance period during which the persons were insured for unemployment, for the time after December 31, 2001, as follows:

– up to 3 years of work experience – 4 months;

– from 3 years and 1 day to 7 years – 6 months;

– from 7 years and 1 day to 11 years – 8 months;

– from 11 years and 1 day to 15 years – 10 months; over 15 years – 12 months.



Exceptions outside this framework apply to unemployed persons whose legal relations with the employer have been terminated at their request or with their consent, as well as for those who have been disciplinary dismissed. This includes situations where the worker leaves work voluntarily or by mutual agreement with the employer, as well as cases where the employer is forced to fire the worker due to his culpable behavior.

The unemployed receive less than the minimum wage

In such cases unemployed persons are not entitled to the full unemployment benefit, as provided by the general rules. The compensation period is reduced. If you do not start a new job and register with the Labor Bureau as unemployed, you will receive the minimum amount of unemployment compensation in the amount of BGN 18 for a period of 7 months.

The right to cash compensation for unemployment is an important tool to protect the social rights of citizens and to support their financial status during periods of unemployment. Providing such measures is essential in trying to address the economic and social challenges facing societies in the modern world.
