The distinction of the Union of Lawyers in Bulgaria (SUB) is a high mark for me and my professional qualities, but also for my colleagues in the prosecutor’s office where I work. This was told to BTA by the deputy district prosecutor of Pleven Nikolay Pachevsky, who was awarded the “Medicine of Honor of the SBU for professional achievements and active union activity”.

“The award is a huge honor for me. I received it in interesting times, in which not good messages are sent to the prosecutor’s office from many directions,” he added.

Asked to comment on the debated constitutional changes, prosecutor Pachevsky emphasized that “everyone is worried about the amendments made to the basic law, the violation of the procedure by which they were adopted and essentially the changes provided for in the bodies that are vitally important for the work of the prosecutor’s office”.

“The main personnel body, constitutionally provided for, was closed and two others were created in its place. The direction that the legislator had set for these amendments was to limit political influence on the organs of the judiciary. However, the decision that was made, the norms, which were adopted, as far as the Prosecutor’s Council is concerned, lead to the exact opposite – it will have two prosecutors and one investigator, and the other members will be appointed by the National Assembly, which is the most political body in the country, and there is even a ban on them are prosecutors or investigators,” noted the deputy district attorney.

In his words, the legislator did not listen to the opinion of the Venice Commission on limiting the political quota in the self-governing magistrate bodies.

Prosecutor Pachevsky described as unfortunate the decision to limit the prosecutor’s office in its general supervision of the legality of administrative and civil acts. “The public prosecutor’s office is a very necessary advocate of the state in cases where the subjects either do not have the opportunity or are in a position to not be able to defend their rights. The court works after being referred to it and those who have the right to do so are the interested parties. In however, in some cases, they cannot due to objective or subjective circumstances or reasons. Then someone has to conduct the procedure in the public interest,” the deputy district attorney also said.

According to prosecutor Pachevsky, cases similar to the “Notary” turn people against the magistrates, lose confidence in judges and prosecutors. “Confidence in the judicial community suffers from such phenomena, and it is called upon to solve important issues, and when there is no trust in it, it is not good for the legal order,” the magistrate stressed.
