Petel.bg – news – In Razgrad, a man was sentenced to 2 years in prison for stealing a bicycle and using foreign bank cards

District Court – Razgrad imposed a general punishment of 2 years “imprisonment” and a fine of BGN 500 on I.I. from the city of Zavet for illegal use of 2 foreign bank cards and theft of a bicycle.

On August 25, 2023, the defendant returned from Germany and asked an acquaintance to pick him up from Targovishte and take him to Zavet. On the way, he explained to him that he had nowhere to spend the night and asked to shelter him. The defendant’s friend agreed and put him in a separate room in his home, which was located in a village near Zavet. Around midnight I.I. went to the kitchen and there he found a purse with a debit card that belonged to his host’s mother. The defendant walked to Zavet and made 12 unsuccessful transactions, the court reported.

After unsuccessful attempts to withdraw money, he stole a bicycle from the yard of a house in Zavet and rode it back to his host’s house and went to bed.

In the late afternoon of the next day, he took his host’s debit card from his car along with a sheet on which the PIN code was written. In the evening, he waited for the owners of the home where he was sheltered to go to bed and again moved to Kubrat on foot. He bought BGN 3.20 worth of drinks at a gas station, and managed to withdraw BGN 470 from an ATM, with one of the transactions failing due to a wrong PIN. With the withdrawn money, I.I. paid a taxi driver who took him to a trading village.

The next day, the injured host discovered the lack of the card and filed a report at the Ministry of Internal Affairs – Kubrat, after which pre-trial proceedings were initiated and the Ministry of Internal Affairs officials revealed the perpetrator of the criminal acts – 22-year-old I.I. The man has been convicted several times, serving a probation sentence for causing bodily harm and imprisonment effectively for theft.

The court found the defendant guilty that on August 26 and 27, 2023, in the cities of Kubrat and Zavet, he acted in the conditions of a continuing crime and used data from payment instruments – 2 debit cards, making successful and unsuccessful transactions with them and one debit card payment of a total value of BGN 643.20, without the consent of the holders.

The court also found the defendant guilty of the second charge brought by the District Prosecutor’s Office, according to which on 26.08.2023 in Zavet he took someone else’s movable property – a bicycle worth BGN 180, without the owner’s consent, with the intention of illegally misappropriating it.

For the committed crimes of I.I. he was given a general sentence of 2 years of “imprisonment” and a fine of BGN 500, to be served under an initial strict regime. He will pay to the account of the OD of the Razgrad Ministry of Internal Affairs and costs of the proceedings in the amount of BGN 83.97.

The decision of the court is subject to protest and appeal within 15 days before the Court of Appeal – Varna.
