The European Commission has sent an official warning letter to Bulgaria and other member countries, in which it insists that they adhere to public procurement legislation, as well as to transpose the directive for the trans-European transport network TEN-T.

The Commission sent a reasoned opinion to Bulgaria and 5 other member states because they have not transposed the directive into their legislation, which lays down measures to advance the implementation of the trans-European transport network. It aims at the smooth completion of major projects by making permitting and public procurement procedures clearer, the Commission emphasizes.

Countries must respond within two months or the Commission can refer them to the Court of Justice of the EU.

The same can happen to Bulgaria if it does not respond within the same time frame to the official warning letter because we do not follow the public procurement legislation. We are talking about various problems, among which the limitation of the rights of the operators and the exclusion of private hospitals from the public procurement rules in the EU, although in Bulgaria they are partially financed by public funds.

The Commission also sent an additional official warning letter to Bulgaria for not correctly transposing the directive on strengthening the presumption of innocence and the right to be present at the trial in criminal proceedings.

The first warning letter was sent to our country in September last year, but the Commission has discovered additional problems in the transposition of texts on trials in the absence of the accused and the right to a new trial.

The Commission also sent an additional official warning letter to Bulgaria and 4 other member countries, in which it insists that they adhere to the cross-border judicial procedures under the European Arrest Warrant. According to the Commission, Bulgaria has not correctly transposed the texts related to the detention of wanted persons.
