Another Plovdiv resident managed to sue the Plovdiv Municipality because of a fallen tree that gutted his car during last year’s storm in March. Although he had filed a report about the rotten trees as early as 2022, the district administration did not take any action and quite logically the accident happened.
In the case, it was clarified that on March 27, the weather was rainy and there was a strong wind. One of the rotten trees broke off and fell on the parked car. The owner then tried to start the vehicle, but it proved impossible, so the next day the plaintiff transported the vehicle via repatriation. He paid BGN 60 for the repatriation service. A week after the accident, the car was inspected by an auto expert, who prepared photographic material and a private expertise. He found that the repair exceeded the value of the car and its restoration was inexpedient. In view of the findings on May 5, 2023. the car’s registration was suspended.
The man filed a lawsuit in the Plovdiv District Court, and the Municipality of Plovdiv disputed the claim, as well as all the circumstances surrounding the incident.
In the case, the conclusion of the prepared auto technical expertise was accepted, according to which, in the mechanism of the accident, for which there is data in the case, namely the impact of the passenger car by a fallen tree, from a technical point of view it is possible to damage the specified details to the appropriate degree. The market value of the repairs to restore the damage to the car is BGN 13,207. The average market value of the car at the date of the event was BGN 12,274. The car is technically possible to restore, as the repair value represents 107% of the car’s value before its damage. The value of the car handed over for scrap is BGN 581. The difference between the price of the car before it was damaged and the price of the car after it was damaged is BGN 11,964, that is, this is the value of the property damage caused.
For this reason, the court also sentenced the Municipality of Plovdiv to pay the Plovdiv resident the sum of BGN 13,207 representing compensation for property damage suffered. The municipality must also pay the costs of the case, which amount to just over 2,700 BGN.
The decision is subject to appeal before the Plovdiv District Court.
