The U.S. Supreme Court has indicated it is unlikely to grant former President Trump’s immunity request. Supreme Court justices today considered for the first time a request by Trump, who believes that as a former president he cannot be tried on charges of trying to manipulate the results of the 2020 election.

At least five of the nine justices seemed unconvinced by the claim that the US president always enjoys immunity from prosecution. Some conservative justices lean toward the view that presidents enjoy some immunity.

Trump’s lawyers have said the president cannot properly carry out his duties if he has to worry about criminal charges and that politically motivated lawsuits against former presidents are becoming common if the president does not enjoy full immunity.

Election fraud

If the Supreme Court rules that Trump is not fully immune, special counsel Jack Smith’s case against Trump could continue. In this case, Trump is suspected of manipulating the results of the presidential election. He lost to Joe Biden, but falsely insisted the election was rigged.

This is one of four criminal cases against the former president. Trump was absent today from the Supreme Court in Washington because he had to be in New York for a criminal case against him related to secret payments to former porn star Stormy Daniels.

delay

It is not clear when the Supreme Court will issue its decision. Chief Justice John Roberts said he had “concerns” about a lower court’s previous ruling against Trump, which he said was based on flawed reasoning. Roberts wondered if the case should go to the lower courts first.

Such a ruling would significantly delay the Supreme Court’s decision on the immunity issue. That makes it unlikely that Special Counsel Smith’s criminal case will begin before the November presidential election. Trump took advantage of this as the only remaining Republican presidential candidate.

The special prosecutor has already asked the Supreme Court for a quick decision.
